The conversation at the Cambridge Applestore went like this:
I’ve got a problem with my iPhone touchscreen not responding in the bottom section ——- well, I’ll have to make you an appointment with a Genius.
But I just drove 40 miles and your website said “simply take your phone to an Applestore” - whatever, I had to wait 1 hour 15.
Genius - Your phone hasn’t been avctivated, sir.
Reply - No - but it is in a fully restored factory condition.
Genius - Have you seen the sign (right in front of me) about Apple not being responsible for jailbroken iPhones and warranty rights.
Reply - Yes. (Why would that be of interest to me?)
Genius - Ohh - long pause - much frantic typing on keyboard.
Genius - I can’t put it through I will have to go and talk to someone else (disappears through door and consults the Über-Genius).
Genius - I’m sorry (he wasn’t), but we can’t help because the diagnostic software will not run on a locked phone.
Reply - I am only here because I read on your support site last night that “Failure to activate an iPhone does not affect your warranty rights”. Furthermore, you could not run your diagnostic software on a phone that was dead and needed warranty repair.
Genius - Ohh. I’ll try and run the diagnostic software then….Ohh, it’s running….Ohh…..Ohh….OK….right….well….I’ll just go and get your replacement phone then…..

Apple customer service remains the best!
(I did note that as it had not been activated yet, the purchase date was assumed as 26/11/2007).
